U Bosni i Hercegovini, kleveta i uvreda su sve do 1999. godine potpadale pod Krivični zakon. Tačnije, u zemljama bivše Jugoslavije, posebno je član 133. Krivičnog zakona, nazivan “verbalni delikt” korišten za obračunavanje sa neistomišljenicima, i brojni su primjeri kada su građani osuđeni na zatvorske kazne zbog navodnog kršenja odredbi ovog člana. Kada su početkom XXI vijeka kleveta i uvreda dekriminalizovana, zakoni o zaštiti od klevete su ocijenjeni kao dobro skrojeni i u skladu sa međunarodnim standardima slobode izražavanja, pa je prema indeksu medijskih sloboda BiH zauzimala veoma visoko mjesto, što je doprinosilo demokratizaciji društva.
Formulacije korištene u Nacrtu Krivičnog zakonika RS široko postavljaju definicije krivičnog djela. Imajući u vidu da se kriminalizuje govor, tekst ostavlja značajan prostor za različita tumačenja različitih odredaba, koje mogu dovesti do neujednačene primjene zakona i narušiti pravnu sigurnost. Također, imajući u vidu kombinaciju širokih formulacija i visokih kazni, ove formulacije imaju potencijalno vrlo značajan chilling effect. Iako je pitanje legitimnog cilja u pravilu formalnost u praksi ECtHR-a, način na koji je Nacrt pozicioniran u javnom diskursu ostavlja sumnju u intencije zakonodavca. Osnovi za isključenje protivpravnosti preuzeti iz KZ SFRJ ne doprinose uklanjanju potencijala za neujednačenu primjenu, odnosno ne pružaju zaštitu od manjka pravne sigurnosti i chilling effecta. Krivična odgovornost za klevetu i uvrede u RS bi predstavljalo dodatni instrument za vođenje strateških postupaka protiv javnog sudjelovanja (SLAPP), a što bi rezultiralo sa autocenzurom među novinarima, aktivistima, akademskim radnicima i građanima.
U konačnici, to bi dovelo do osiromašenja javne rasprave o temama koje su od javnog interesa, te spriječilo novinare i aktiviste da vrše svoju funkciju čuvara javnog interesa (public watchdog). Kriminalizacija klevete i uvrede u RS bi bila protivna standardima koje su razvili EU, CoE, OSCE i UNESCO. Zakonodavac ne može izignorisati postojanje konsenzusa na nivou ovih organizacija o nužnosti dekriminalizacije klevete, a posebno ne može zanemariti stav Evropske komisije o dekriminalizaciji. To posebno, ako imamo u vidu obavezu harmonizacije prava BiH sa pravom EU i međunarodnu obavezu entiteta da pomognu BiH prilikom izvršenja njenih obaveza u procesu EU integracija.
Cilj ove intervencije jeste pojasniti pravne posljedice klevete u domaćem pravu, objašnjavajući položaj u kojem će biti mediji i svi drugi članovi društva koji mogu biti procesuirani u slučaju da dođe do kriminalizacije klevete. Dodatno je cilj da se ukaže na pravne posljedice izmještanja postupka za razmatranje klevete iz parničnog postupka u krivični postupak i ukazati na poteškoće koje će osumnjičeni/optuženi imati.
The Center for Democracy Foundation, in cooperation with partner civil society organizations from the Western Balkans, held the first in vivo project management team meeting on the next steps in the implementation of the project “Regional Youth Dialogue for Europe – RYDE”from May 24-26, 2023 in Niš.
After the two previous online PMT meetings, meeting in Niš was a good opportunity for joint discussion the key tasks and work methodology to be implemented within the three-year regional project, as well as preparatory activities in order to organize the traditional “POLITEIA Regional School for Youth Participation” that will take place from July 6-12, 2023 in Niš.
The representatives of all partner CSOs took participation in the PMT meeting. Ms. Hillen Francke, Head of Sector Western Balkans Regional Programmes (Civil Society, Social Inclusion and Human Capital Development) at the European Commission’s DG NEAR, Ms. Irena Radinović from the Delegation of the European Union to the Republic of Serbia and Mr. Ognjen Marković from the Regional Cooperation Council (RCC) addressed the PMT members via Zoom.
“Regional Youth Dialogue for Europe” is a three-year regional project (2023-2026) aimed to: Increased participation of youths in decision-making, improved understanding and cooperation in the Western Balkans and strengthening active citizens` support for EU integration.
By supporting CSOs and, in particular, youth organisations, we will empower the citizens in the Western Balkans: to actively advocate for the adoption of EU values and the empowerment of responsible democratic institutions, to take part in public dialogue on reforms and development perspectives, to spread knowledge pertaining to the economic and social progress brought about by the adoption of EU standards, to work together on the advancement and implementation of common cause projects, to overcome issues resulting from the region’s turbulent past through dialogue and cooperation and to support neighbourly relations and reconciliation.
The Regional Youth Dialogue for Europe Project is implementing by the Center for Democracy Foundation (CDF), Belgrade (as project coordinator) and partner organizations: Academy of European Integration and Negotiations from Tirana (AIEN); Kosovo Stability Initiative from Pristina (IKS); Association Network of Progressive Initiatives from Sarajevo (NPI); NGO Info Center from Skopje (NGO IC); Regional Academy for Democratic Development from Novi Sad (ADD); Youth Act Center from Tirana (YA). The project is funded by the European Union.
We invite you to apply for the POLITEIA Regional School for Youth Participation that will take place July6-12, 2023 in Niš, Serbia.
The first POLITEIA School for Civil Society took place in 1997 where youth gained valuable knowledge of democratic and European values. Since then, hundreds of young people were taught and motivated to actively participate in social and political processes. POLITEIA is recognized as one of the leading non-formal educative programs for because of its great choice of lecturers, interactive methodology as well as choosing qualified participants. POLITEIA was raised to a regional level during a three-year regional project “Regional Youth Compact for Europe – RYCE” (2018-2021) and participation is now available for young people from the entire Western Balkans region. POLITEIA Regional School is organized within the three-year regional project “Regional Dialogue for Europe” funded by the European Union.

Participation in the POLITEA Western Balkans School for Youth Participation is open to final-year undergraduate high school students, students, young professionals and activists from the age of 18 to 25 from Albania, Bosnia and Herzegovina, Montenegro, Kosovo*, Serbia and North Macedonia. Participants will be chosen according to their academic, activist and other achievements as well as their motivation for being part of POLITEIA alumni network.
Successful candidates will be those who have a strong interest in acquiring new knowledge about the social, economic and political benefits of the European integration of the Western Balkans, youth policies, youth networking at the regional and European level, as well as mechanisms for participation in the process of creating and implementing public policy.
Certificate for successfully completing POLITEIA Regional School for Youth Participation will be awarded to the POLITEIA participants.

Center for Democracy Foundation started implementing the Regional Youth Dialogue for Europe Project in cooperation with civil society organizations from the Western Balkans region.
Young people from Western Balkan region believe they are not sufficiently visible nor involved in the processes concerning their future. It is necessary to improve the participation of youth representatives in democratic societies and civil society organizations, as well as their cooperation in the region. Also, it is highly important to strengthen the dialogue of young people with decision-makers.
The Project is implemented in the context of the implementation of the EU Youth Strategy, the accompanying Action Plan for the Western Balkans and the Economic-Investment Plan for the Western Balkans, which established the Youth Guarantee program.
We are incorporating in the Project our experience in the promotion of European and democratic values and human rights, the Sustainable Development Goals and 2030 Agenda, with a particular focus on improvement of the status of young people and members of vulnerable groups, as well as the experience of encouraging public dialogue, creating and monitoring public policies and involving citizens in the decision-making process.
We shall empower SCO, particularly youth organization activists and citizens throughout the region to:
Advocate for the adoption of European values and strengthening of democratic and responsible institutions
Participate in public dialogue on reforms
Spread knowledge about the economic and social progress to be brought about by the adoption of European standards in public policies
Cooperate on design and implementation of common cause projects

Friedrich-Ebert-Stiftung BiH (FES) i Mreža progresivnih inicijativa (MPI) organiziraju edukativni program za mlade političke aktere/ke pod nazivom ECOpolitics School, koji će biti održan u periodu mart-juni 2023. godine.
Šta je tema škole ECOpolitics? Zagađenost zraka i vode, uništavanje prirodnih resursa, upravljanje otpadom, energetska kriza i pravedna tranzicija samo su neke od teme o kojima će biti riječ na ovogodišnjoj ECOpolitics školi. Uz to, polaznici i polaznice će zajednički sa organizatorima učestovati u kreiranju agende i tema koje su njima najinteresantnije, te će dobiti stručnu i mentorsku pomoć za izradu unutarstranačkih ili javnih inicijativa. Sadržaj škole uključuje interaktivni sadržaj i različite formate neformalne edukacije i političkog aktivizma.
KO MOŽE UČESTVOVATI? Ukoliko si izabrani vijećnik/ca, odbornik/ca ili zastupnik/ca, imaš do 35 godina, te želiš saznati više o gore navedenim temama s ciljem daljeg političkog djelovanja, onda je ovo program za tebe. ECOpolitics škola će ti dati priliku da razmijeniš iskustva sa drugim mladim ljudima širom BiH, te unaprijediš svoja znanja i vještine za društveno i političko djelovanje u oblasti zaštite životne sredine. Namjera škole je da okupi mlade političare/ke koji u svom javnom djelovanju ne koriste govor mržnje, diskriminaciju, nacionalističku retoriku, ili na bilo koji drugi način osporavaju ljudska prava i slobode.
ŠTA JOŠ DOBIJAM UČEŠĆEM U ŠKOLI? Osim novih znanja iz oblasti životne sredine, svi polaznici će dobiti mentorsku podršku za kreiranje vlastitih individualnih ili grupnih političkih inicijativa za unutarstranačko ili javno djelovanje. Organizatori će i nakon završetka škole pružiti podršku u promociji inicijativa i pratiti njihovu dalju implementaciju. Po završetku škole će uspješnim polaznicima i polaznicama biti dodijeljeni certifikati.
RASPORED ŠKOLE Svi odabrani polaznici/e su obavezni učestvovati na sva tri modula škole. Modul I – 09.-12.03.2023. godine Modul II – 12-14.05.2023 godine Modul III – 16.-18.06.2023. godine
Dolazak učesnika/ca se očekuje u kasnim poslijepodnevnim satima prvog dana modula. O tačnim lokacijama održavanja modula odabrani polaznici/e bit će blagovremeno obaviješteni.

KO MOŽE UČESTVOVATI? Ukoliko imaš između 18 i 35 godina, živiš u Bosni i Hercegovini, član/ica si političke partije ili si istaknuti/a mladi/a lider/ka u svojoj lokalnoj zajednici kroz omladinski ili građanski aktivizam, te želiš saznati više o gore navedenim temama s ciljem daljeg političkog/aktivističkog djelovanja, onda je ovo program za tebe. ECOpolitics škola će ti dati priliku da razmijeniš iskustva sa drugim mladim ljudima širom BiH, te unaprijediš svoja znanja i vještine za društveno i političko djelovanje u oblasti zaštite životne sredine.
